Terms of Sales
The general conditions of sale define the conditions of access and use of the site accessible via www.chems-paris.fr (below, the site ), which the company CHEMS PARIS makes available to Internet users.
We draw the Customer's attention to the fact that the photographs illustrating our products may be slightly different from reality due to the Customer's screen settings and lighting during photography.
In addition, as these are artisanal creations, the items may present irregularities in finish and differences in format, which cannot be considered as defects. The Company's liability cannot be called into question, and the validity of the order cannot be affected.
TERMS AND CONDITIONS
1. OBJECT
The “General Conditions” govern the conditions of ordering, payment, delivery and management of possible returns of products ordered by customers on the site www.chems-paris.fr .
The General Conditions of Sale are enforceable against the customer who declares having read them and accepted them by checking the box “ I accept the General Conditions of Sale » before implementing the online ordering procedure.
2. CUSTOMER
The customer of the site is the adult and legally capable natural person having the status of consumer.
3. PRODUCT
The characteristics of the products are presented on the site www.chems-paris.fr inside each product sheet: the materials of the products, the dimensions, etc.

4. ORDERS
To place an order, the customer must follow these steps:
- Make a selection of products (Phone Cords, Charms...)
- Add comments in the box provided for this purpose (Personalization, special requests, words or numbers for Color Phone Cords, etc.)
- Finalize your order and fill out the form to indicate the necessary personal data (delivery address, delivery information, etc.)
- Choose your payment method (by Mollie bank card or via Paypal)
- Read the General Terms and Conditions
- Add a promotional code if existing
- Proceed to payment
It is up to the customer to verify the details of the order – in particular the total price of his order taking into account the price of the products, the delivery terms and costs, VAT – and the accuracy of the information he communicates.
The prices of the products are indicated on the site in euros, VAT included, but excluding customs fees and other taxes. Customs fees and other taxes must be paid by the customer directly to the carrier depending on the country of destination. Packaging, order processing and shipping costs are indicated before validation of the order.
MIPAR reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons. In these cases, the customer will be informed by telephone or email.
In the event that the products presented on the site are no longer available or on sale at the time your order is sent, the Company must inform you promptly, before 30 working days from the day following your order, of the possible unavailability products ordered. If the price is paid, you will be refunded the full amount advanced.
The contract is deemed concluded upon receipt of the order after verification of the accuracy of the data relating to the order.
Following validation of the order, a notice of receipt will be sent by email to the customer, containing a summary of the order (essential characteristics of the product, price, means of payment, right of withdrawal, delivery times and costs).
Product prices may be modified at any time and without notice, particularly due to changes in the economic, legislative and fiscal framework. The products are invoiced on the basis of the price in effect when the customer places the order.
5. PAYMENT
The site offers payment via Mollie or Paypal . When the order is finalized, we will confirm payment by sending the customer a summary email.
The prices displayed on the site are expressed in euros , all taxes included (French VAT and other taxes applicable on the day of the order).
Payment for purchases is made via the secure platform of our partner Mollie or Paypal .
For delivery outside the European Union, the customer must pay customs duties or other taxes due when importing the products into the country of delivery. The related formalities are also the sole responsibility of the customer. The customer is solely responsible for checking the possibilities of importing the products ordered with regard to the rights of the territory of the country of delivery.
6. DELIVERY
The products are delivered using the shipping method chosen by the customer to the delivery address indicated on the order form.
Our products are delivered worldwide. No deliveries can be made to a hotel address.
Any change of delivery address made by the customer after registration of the order may result in an extension of the delivery time.
The customer has the possibility of obtaining the cancellation of the order under the conditions provided for in article L 216-2 of Consumer Code , that is to say by registered letter with acknowledgment of receipt, after having ordered the Company to make delivery within a reasonable time by registered letter with acknowledgment of receipt, without the Company having complied .
7. RECEIPT OF PRODUCTS
Upon receipt of the product, the customer must immediately check, in the presence of the carrier, the condition of the packaging and the delivered product.
If the packaging is damaged, torn or opened, the customer must check the condition of the products it contains. If these products have been damaged, the customer must refuse the package and note a reservation on the delivery slip: damage, missing item, damaged package, broken item, etc. This verification is deemed to have been carried out as soon as the customer, or a person authorized by him, signed the delivery note.
The customer must then confirm his reservations to the carrier by registered mail at the latest within three days, not including public holidays, following that of receipt of the products and send a copy of this letter to the CHEMS PARIS Company.
Failure to comply with said deadline does not hinder the customer's recourse to obtain an exchange or refund of the products. Likewise, the customer always benefits from his right of withdrawal under the conditions of article 9 “Right of withdrawal” above.
8. GUARANTEES
All items for sale on www.chems-paris.fr have a 3-month warranty from the date of delivery of the order.
When the customer purchases a product, he benefits from legal and commercial guarantees under the conditions provided respectively by articles L 217-4 et seq. of the Consumer Code and 1641 et seq. of the Civil Code. The warranty only applies in cases where there is a manufacturing defect, and in the event that the damage to the product has not been caused by improper use of it.
The Company will study in detail the reason for the damage in each case. To request execution of the warranty, the customer must write to chemsparis@outlook.fr
8.1 Legal guarantee of conformity
The legal guarantee of conformity concerns all defects in conformity already existing on the date of delivery of the product. For example, if the product delivered does not correspond to the description (color, dimensions, materials) or if the product does not function according to the expected use. The customer benefits from a period of 2 years from the delivery of the property to use it. He will thus be required to choose between repair and the replacement good.
If these 2 options are impossible – for example if the manufacture of the product has been stopped – or cannot be implemented within the month following the complaint, the customer can be reimbursed in full (by returning the product) or partially (by keeping the product).
8.2 Legal guarantee against hidden defects
This guarantee protects the consumer against hidden product defects. The customer benefits from a period of 2 years from the discovery of the hidden defect to implement it.
Two solutions are possible:
- the customer keeps the product and requests a price reduction
- the customer returns the product and requests reimbursement of the price paid as well as the costs incurred by the sale.
9. CUSTOMER’S RIGHT OF WITHDRAWAL
The customer has 14 days to change their mind about their purchase. The right of withdrawal also applies if the product is on sale, second-hand or out of stock.
The right of withdrawal can be exercised from:
– finalization of the order;
– receipt of items.
Before the expiration of this 14-day period, the customer must inform customer service of their decision to withdraw by sending them the standard withdrawal form (provided with the contract) or another written document clearly expressing their desire to withdraw and mentioning the order number to: chemsparis@outlook.fr.
The customer must return the product at his own expense to the address mentioned on the withdrawal form at the latest within 14 days following communication of his decision to withdraw.
If part of an order is returned, the seller will reimburse the delivery costs in proportion to the number of items returned, except in the case of flat rate delivery costs.
The Company must reimburse the customer, including delivery costs, no later than 14 days from the date on which it actually collected the product or from the date on which the customer provided it with proof of receipt. shipping of the product.
Reimbursement will be made by bank transfer to the card used to pay the initial invoice.
It is not possible to replace or exchange returned products. You will need to place a new order online.
For returns of personalized products: article L 121-20-2 of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized. However, we undertake to reimburse you for clearly personalized products that do not correspond to your order (defective or non-compliant).
10. RETURNS & EXCHANGES
Trades
The conditions for requesting an item exchange are as follows:
– products damaged upon receipt;
– the product does not meet expectations.
All products returned for an exchange must be in perfect condition and without obvious signs of use. Otherwise, CHEMS PARIS will not be able to carry out an exchange.
The customer is responsible for providing the correct packaging to ensure that all items arrive at their destination in perfect condition (the original small cardboard box – received with the initial order – may be reused).
Exchanges are accepted up to 14 days after receipt of the shipping confirmation email.
To exchange the ordered items, the customer must download the returns form in the “returns” section at the bottom of the website.
Once the exchange declaration is approved by customer service, a new item will be returned and the customer must return the product to be exchanged in return.
For international exchanges, our customer service will inform you of the procedure and conditions to follow.
CHEMS PARIS will refuse returns/exchanges of personalized models.
Returns
After approval of a return, the item must be returned to the address provided. The customer must carefully complete the exchanges and returns form and include it in the package to be returned.
Upon receipt, the customer will receive a confirmation email indicating the amount refunded within 2 to 3 working days.
Reimbursement of the amount due will be made by bank transfer or according to the original method of purchase.
Exchanges are accepted up to 14 days after receipt of the order.
All costs associated with product exchange will be at the buyer's expense.
For international exchanges, CHEMS PARIS will inform the customer of the procedure to follow and the corresponding cost.
10. EFFECT OF THE CONTRACT
The contract produces all its effects upon its conclusion and cannot be terminated unilaterally by either party, unless the customer uses his right of withdrawal under the conditions set out in articles L 221-18 et seq. Consumer Code.
11. DISPUTE SETTLEMENT
In the event of a dispute, the customer must first contact Customer Service by email: chemsparis@outlook.fr
In the absence of a solution within 21 days following his request, the customer can contact the Joint Direct Sales Mediation Commission free of charge in writing (mail or email addressed to info@cpmvd.fr ) with all the documents useful for understanding the file: explanatory and supporting documents, purchase order, credit contract, letters exchanged with the professional, etc.
12. APPLICABLE LAW AND COMPETENT JURISDICTION
The general conditions of sale are subject to French law. In accordance with consumer law, in the absence of an amicable agreement, all disputes to which the General Conditions of Sale could give rise, concerning its validity, its interpretation, its execution, its termination, their consequences and their consequences will be submitted to the competent court in accordance with the jurisdictional rules of common law.
